1. About These Terms
These Terms of Service form a legally binding agreement between KissBook Pty Ltd ABN 30 689 550 525 (“KissBook”, “we”, “us”, “our”) and any caravan park, accommodation provider or operator (“Park”, “you”, “your”) that registers for or uses the KissBook platform.
By creating an account or using KissBook, you agree to these Terms in full. If you do not agree, do not use the platform.
2. Definitions
“Platform” means the KissBook software-as-a-service, including all web interfaces, tools, and integrations provided by KissBook.
“Booking” means any reservation of an Active Site for a guest created through the Platform — regardless of the booking status assigned (including Confirmed, Pending, Processing, Blocked, or Cancelled) and regardless of the payment method used.
“Active Site” means any campsite, cabin, powered site, or other accommodation unit with an Active status in the Platform.
“Booking Fee” means the flat fee of $3.00 AUD (GST inclusive) charged per Booking, as set out in Section 5.
“Alternative Payment Method” means any payment collected by a Park from a guest outside of the Platform’s Stripe-integrated card payment flow — including cash, bank transfer (EFT), cheque, or any other method.
“Early Access Program” means the current pre-general-release phase of the Platform, as described in Section 3.
“Long-Term Tenancy” means a tenancy arrangement created through the Platform where a guest occupies an Active Site on an ongoing basis under a recurring Billing Cycle. A Long-Term Tenancy is recorded as a single Booking in the Platform.
“Billing Cycle” means the recurring payment period applicable to a Long-Term Tenancy — being weekly, fortnightly, or monthly, as agreed between the Park and the tenant.
3. Early Access Program
The Platform is currently in an Early Access phase. This means:
- Features may change. We are actively developing KissBook. Features, workflows, and interfaces may be added, modified, or removed.
- Pricing may change. Booking Fees and any future subscription pricing may be adjusted. We will provide at least 30 days’ written notice before any fee increase takes effect.
- The Platform is provided as-is. While we work hard to keep KissBook reliable, we do not guarantee uninterrupted availability during Early Access. We will communicate planned downtime where possible.
- Your feedback matters. Early Access participants help shape the product. We may contact you for feedback; participation is appreciated but not required.
Early Access status does not exempt Parks from these Terms, including all fee obligations in Section 5.
4. Our Services
KissBook provides an online booking management platform for caravan parks and campgrounds, including:
- Guest-facing booking and payment processing
- Calendar and site availability management
- Booking administration tools for park operators
- Stripe payment integration for card payments
- Monthly invoicing for bookings settled via Alternative Payment Methods
5. Booking Fees
5.1 Fee Structure
A Booking Fee of $3.00 AUD (GST inclusive) applies to every Booking created through the Platform. This fee is non-negotiable and applies regardless of:
- The booking status (Confirmed, Pending, Processing, Blocked, or Cancelled)
- The payment method used (card, cash, EFT, or any other method)
- Whether the booking was initiated by a guest or entered manually by the Park
5.2 How the Fee Is Collected
- Card payments: The Booking Fee is automatically included in the guest’s total at checkout and collected through the Platform’s Stripe integration. The Park receives the guest payment minus Stripe processing fees; KissBook’s Booking Fee is collected separately.
- Alternative Payment Methods: Where a guest pays by cash, EFT, or any other method outside the Platform’s card flow, the Booking Fee is not collected at checkout. KissBook will invoice the Park monthly for all such outstanding Booking Fees (see Section 6).
5.3 Cancellations
The Booking Fee is non-refundable in the event of a guest cancellation or booking modification. If a guest cancels, the Park may refund the guest according to its own cancellation policy, but the Booking Fee is retained by KissBook and remains owing regardless.
5.4 Fee Obligation Attaches at Booking Creation
The Booking Fee becomes owing at the time a Booking is created — not at the time of payment, and not at the time of check-in. Changing a booking’s status after creation (including to Cancelled or Blocked) does not extinguish the Booking Fee obligation. For Long-Term Tenancies, this obligation arises at the start of each Billing Cycle.
5.5 Long-Term Tenancy Fees
For Long-Term Tenancies, the Booking Fee applies per Billing Cycle payment rather than per Booking record. A single Long-Term Tenancy will therefore generate one Booking Fee for each billing period for the duration of the tenancy, including open-ended tenancies, until the tenancy is formally ended in the Platform.
- Card payments: The Booking Fee is automatically added to each periodic rent payment processed through the Platform’s Stripe integration.
- Alternative Payment Methods: Where rent is collected by cash, EFT, or any other method outside the Platform, KissBook will invoice the Park monthly for all outstanding Booking Fees from that period.
If a Long-Term Tenancy ends mid-cycle, the Booking Fee is owed for any billing period in which a rent payment was collected or became due.
6. Payment & Invoicing
6.1 Stripe Fees
Parks use their own connected Stripe account to receive card payments. Parks are solely responsible for all Stripe processing fees. KissBook is not liable for any Stripe fees, disputes, chargebacks, or Stripe account issues.
6.2 Monthly Invoicing for Alternative Payments
KissBook will issue a tax invoice to the Park on or around the first business day of each calendar month, covering all Booking Fees from the prior month that were not collected through the Platform’s Stripe payment flow.
Payment is due within 14 days of the invoice date.
6.3 Overdue Invoices
KissBook reserves the right to:
- Charge interest on overdue amounts at a rate of 10% per annum, calculated daily
- Suspend or restrict Platform access until outstanding invoices are paid in full
- Engage a debt collection service for amounts more than 60 days overdue
- Report outstanding debts to relevant credit agencies
6.4 Disputes
If you believe an invoice contains an error, you must notify KissBook in writing within 14 days of the invoice date. Disputed amounts must still be paid in full pending resolution. If the dispute is resolved in your favour, KissBook will issue a credit note.
7. Fair Use & Prohibited Conduct
7.1 Genuine Use Required
You agree to use the Platform in good faith and for its intended purpose: managing legitimate guest bookings and site reservations for your park.
7.2 Fee Circumvention Prohibited
You must not use the Platform in any way designed to avoid or reduce your Booking Fee obligations. Prohibited conduct includes but is not limited to:
- Reserving a site for a guest using the Platform, and then collecting payment from that guest outside the Platform
- Cancelling a Booking after payment has been collected from a guest in order to avoid the Booking Fee
- Entering false or misleading information about bookings, payment methods, or guest transactions
- Any other manipulation of booking records, statuses, or data intended to reduce the number of billable Bookings
7.3 Audit Rights
KissBook reserves the right to review your booking records, invoicing history, and Platform usage at any time to verify compliance with these Terms. Where KissBook reasonably determines that Booking Fees have been avoided through prohibited conduct, KissBook may:
- Issue a retrospective invoice for all Booking Fees owed
- Suspend or terminate your account
7.4 Other Prohibited Conduct
You also must not:
- Share login credentials with unauthorised parties
- Attempt to reverse-engineer, scrape, or copy the Platform
- Use the Platform for any unlawful purpose
- Interfere with the Platform’s operation or security
8. Accounts & Access
You are responsible for maintaining the security of your account credentials. You must notify KissBook immediately if you suspect unauthorised access to your account.
KissBook may suspend access to your account without notice if we reasonably believe there is a security risk or breach of these Terms.
9. Data & Privacy
KissBook collects and handles personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Our Privacy Policy explains how we collect, use, store, and disclose personal information.
By using the Platform, you acknowledge that guest data entered into the Platform is processed in accordance with our Privacy Policy.
10. Intellectual Property
All intellectual property in the Platform — including software, design, content, and documentation — belongs to KissBook Pty Ltd. You are granted a limited, non-exclusive, non-transferable licence to use the Platform during the term of your agreement with us. This licence does not transfer any ownership rights.
11. Warranties & Limitation of Liability
11.1 No Uptime Guarantee
During Early Access, KissBook does not warrant that the Platform will be uninterrupted, error-free, or available at any particular time.
11.2 Australian Consumer Law
Nothing in these Terms excludes any rights you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot be excluded by law.
11.3 Limitation
To the maximum extent permitted by law, KissBook’s total liability to you for any claim arising under or in connection with these Terms is limited to the total Booking Fees paid by you to KissBook in the three months prior to the claim.
KissBook is not liable for any indirect, incidental, special, or consequential loss, including loss of revenue, loss of data, or loss of business opportunity.
12. Termination
12.1 By You
You may terminate your account at any time by contacting KissBook in writing. Outstanding invoices remain payable on termination.
12.2 By KissBook
KissBook may suspend or terminate your account immediately if:
- You breach these Terms and fail to remedy the breach within 7 days of written notice
- You engage in fee circumvention or other prohibited conduct (Section 7)
- Any invoice remains overdue for more than 60 days
- We are required to do so by law
12.3 Effect of Termination
On termination, your access to the Platform ceases. KissBook will retain booking and transaction data in accordance with our Privacy Policy and applicable law. Outstanding Booking Fees remain owing and are immediately due.
13. Changes to These Terms
KissBook may update these Terms from time to time. We will notify you by email at least 30 days before material changes take effect. Continued use of the Platform after the effective date of updated Terms constitutes acceptance.
For changes required by law or to address security issues, shorter notice may be given.
14. Governing Law
These Terms are governed by the laws of Queensland, Australia. Both parties submit to the exclusive jurisdiction of the courts of Queensland.
